Sean Wheller
Can a sectional title owner subdivide or consolidate sections?
Tuesday, 22 January 2008
The straightforward answer is YES, but like everything in sectional title, it is not necessarily simple. The owner must get consent from the trustees first. In addition the owner of the sectional title is obligated to pay a land surveyor or architect to do the plans for the subdivision or consolidation and submit them to the surveyor general for approval. For anyone interested in more information about this, read sections 21, 22, and 23 of the Sectional Title Act 95 of 1986.
