A residential lease agreement with a private tenant vastly differs from a commercial one. It is to be noted a residential lease agreement has to comply with the Rental Housing Act 50 of 1999. Both tenant and landlord in a residential property have rights that are clearly outlined in the Rental Housing act. It is very important that the lease agreement complies with the act, otherwise it may be found null and voice by a court of law, or the Rental Housing Tribunal may find the landlord is engaging in unfair practices. The unfortunate circumstances are that often landlord investors do not know that they also have rights under the Rental Housing Act and to be able to enforce those rights it is highly important to have a good lease agreement.
